HB 827 - Vehicle Laws - Right-of-Way - Penalties for Failure to Yield


This bill was introduced in the Maryland General Assembly for the 2007 session on behalf of ABATE of Maryland which is a grass-roots motorcyclist organization. Motorcycle riders experience visibility and vulnerability issues that are similar to those experienced by bicycle riders.

In an effort to increase the consequences for motor vehicle drivers who cause these accidents and hopefully minimize their occurrence in the future, we are continuing a three-year effort to get legislation through the Maryland General Assembly that will increase penalties for right-of-way violations to include higher fines and license suspension when an injury or fatality is the result of a right-of-way violation.

This bill applies to all vehicles including bicycles.

HB 827 was filed and assigned to the Environmental Matters Committee of the
House of Delegates on February 9, 2007. Additional notices will be sent
when the bill is scheduled for a hearing or other significant event.

The right-of-way violation penalties bill provides for increased penalties
for right-of-way violations when the violation contributes to an accident
that results in bodily injury or death of an another person.

Under current law, the penalty for violating the right-of-way of another
vehicle is $60 and one point against the offenders' license. Even when a
right-of-way violation is combined with another charge like negligent
driving, the maximum fines and penalties for both charges would be $630 and
seven points.

In many accidents of this nature, law enforcement and the courts cannot justify a higher charge that would include more severe penalties and the violators are given only minimal fines and penalties. This bill seeks to give the courts the tools they need to penalize violators appropriately when serious injury or death occurs. This bill applies to all vehicles on the road including cars, trucks, motorcycles, and bicycles.
